迪拜DIFC非穆斯林遗嘱公证小细节





律所撰写好后，客户在网上预约DIFC非穆斯林遗嘱公证处。
一定准时到，不要迟到。
在Al Fattan Currency House 底楼拿证件换一张电梯门禁卡，用驾照或者其他卡，不要用ID或者护照。


各种小疑问：
1，房产买卖了，需要更新遗嘱吗？
答：房产的买卖只需要把房产证编号发送邮件给公证处即可（删除或者添加房产证的编号），无需更新遗嘱。房产证编号可更新可以不更新，因为遗嘱里包含了所有的资产，只是有房产证编号的话会方便土地局那边的工作。
更新遗嘱是当要改变受益人/监护人之类的才更新，而且更新遗嘱的收费是550迪（不是重新收费一次公证费）。

2，护照号码变了，或者居住地址变了，需要更新遗嘱吗？
答：换护照了，护照号码变了，或者居住地址变了，也可以发邮件给公证处即可，无需更新遗嘱。

3，可以自己或者随便找家律所撰写DIFC非穆斯林遗嘱吗？
答：根据DIFC公证处的回复
“ we can only accept wills for registration which have been drafted by the applicant him/herself or on their behalf by a lawyer who is registered with us (see http://www.difcprobate.ae/register-of-will-draftsmen/ ).”只接受在DIFC注册了的律师/律所所撰写的或者指导下撰写的遗嘱进行公证。
邮件里会问是哪家律师事务所撰写/指导的。
所以DIFC公证处只接受注册了的律所/律师撰写的遗嘱。

  


4，公证的时候会问些什么问题呢？
答：公证的时候，公证人员就是检查一下遗嘱，跟立遗嘱的人问几个问题，比如资产给**是吗？执行者是** 是吗？用英文提问，所以立遗嘱者需要会基本简单的英文。

5，哪些人必须到场？
答：立遗嘱者和见证人必须到场

6，哪些人一定不能到场？
答：受益人一定不能到场

7，DIFC非穆斯林遗嘱是什么文字的？
答：英文

8，见证人需要跟立遗嘱者很熟吗？
答：不用，根本不会问见证人任何问题，就是签字就是了

9，护照上签字是中文的，ID卡上签字是拼音/英文的，怎么办？
答：公证的时候，在遗嘱上可以把拼音/英文的和中文的都签上。

公证完毕后，会问您需要几份复印件，一般两份或者三份，如果丢失，需自己本人再去索要复印件，或者授权给律师去索要。

Prior to your appointment

Please complete the attached Information Form and return it to us info@difcprobate.ae
so that we can prepare your case file and ensure that there are no delays on the day of registration.

If your will has been drafted by a lawyer or you have taken advice from a lawyer but drafted it yourself, please provide us with the:
(a)    name of the lawyer, and
(b)    name of their employer.

This is vitally important as we can only accept wills for registration which have been drafted by the applicant him/herself or on their behalf by a lawyer who is registered with us (see http://www.difcprobate.ae/register-of-will-draftsmen/ ).

Please note that wills for registration must be compliant with the minimum standards as set out in Schedule 1 ‘Forms of Will 1 and 2’ of the DIFC WPR Rules.  The Rules are available to download from our website (www.difcprobate.ae/rules/)

Please provide us with the names of those persons who will be accompanying you (eg your witness, attorney, any other party), so that we can pass on their names to the ground floor reception desk.  The reception staff will provide you with temporary access cards, without you having to surrender your ID’s as these will be required at registration.

On the day of your appointment

Please bring the following:

1. Passport and Emirates ID (if applicable)
护照和阿联酋ID（如果有ID）

2. Draft will (this must be unsigned)
遗嘱（一定不能签署，只能在公证处当面签）

3. Any documents you wish to annex to the Will
您想要附加在遗嘱里的任何文件 （其实什么文件都不带也可以，因为遗嘱里包含了现有和未来的资产）

4. Witness Statement(s) from persons to be appointed as ‘Guardian’ (please ensure the witness statement is dated when signed, and otherwise compliant with the DIFC WPR Rules otherwise it will not be accepted)
监护人签署的信件的原件 （一定也要签上日期，否则不接受）

5. A person to act as a witness (that person must be at least 21 years old, and must not be beneficiary or a Guardian under the will). The witness must bring their ID (either their passport or Emirates ID)
见证人（至少21岁，不能是遗嘱里的受益人或者小孩监护人），见证人必须带上证件原件（护照或者阿联酋ID原件）

6. Registration fees (we accept cheques, credit cards and cash)
公证费用（接受支票，信用卡，现金）

It is not a requirement that your lawyer attends the appointment but if they do not, we advise that he/she is contactable by phone.

We are located at the Al Fattan Currency House, Offices 307 & 308, Tower 1, 3rd floor, DIFC (see attached map) and complimentary valet parking is provided. The first 2 hours of parking (valet service in the front of the building – Al Fattan Currency House) is for free, subsequent hours will be charged. It is important to provide your vehicle to the valet service, as visitors parking is not covered.
